1. ACCEPTANCE OF TERMS

By accessing or using the "Is This Quote Expensive?" platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

⚠️ NOTICE: These terms contain a binding arbitration provision and a waiver of class action rights.

2. AI ANALYSIS & DISCLAIMERS

The Service uses Artificial Intelligence (AI) to analyze documents and provide market benchmarks. You acknowledge and agree to the following:

No Professional Advice

The Service provides informational estimates only. It is NOT a substitute for professional quantity surveying, legal, engineering, or financial advice. We do not guarantee the accuracy of any pricing data.

AI Hallucinations

AI systems are probabilistic and may produce inaccurate, outdated, or "hallucinated" results. You agree to independently verify all pricing, codes, and specifications before making financial decisions.

WE ARE NOT LIABLE FOR ANY NEGOTIATIONS, REJECTED QUOTES, LOST CONTRACTS, OR FINANCIAL LOSSES RESULTING FROM YOUR RELIANCE ON OUR DATA.

3. ACCOUNTS & CREDITS

Usage Credits

Some features may require the purchase of "Credits."

  • Credits are non-refundable once purchased.
  • Credits do not expire as long as your account is active.
  • We reserve the right to change credit pricing at any time.

4. USER CONDUCT & REPRESENTATIONS

You agree not to use the Service to:

  • Violate any local, state, national, or international law.
  • Upload documents that you do not have the right to share.
  • Engage in industrial espionage or reverse-engineer competitor pricing unlawfully.

Your Warranty

You represent and warrant that you are the rightful owner of any Quote you upload, or that you have obtained all necessary permissions/licenses from the third party (e.g., the Contractor) to upload the document for analysis.

5. INTELLECTUAL PROPERTY & DATA LICENSE

Your Ownership

You retain ownership of any PDF, image, or text you upload ("Submissions"). We do not claim ownership of your original files.

Our License to Use Data

By uploading a Submission, you grant us a worldwide, royalty-free, perpetual, irrevocable license to:

  • Analyze: Process the file to provide your result.
  • Anonymize: Strip away all personal identifiers (Names, Addresses, Phones).
  • Aggregate: Combine your anonymous pricing data with thousands of others to create market benchmarks.
  • Commercialize Aggregated Data: We may sell, publish, or share these anonymous, aggregated market insights (e.g., "Average cost of a roof in 2026") with third parties for business intelligence purposes.

*We will never sell your original file or your personal contact details. We only monetize the anonymous statistics.

6. PAYMENT & REFUNDS

Payments are processed securely via Stripe. We do not store your credit card information.

Refund Policy:

  • Because the Service provides immediate digital access to data, all sales are final.
  • We do not offer refunds for unused Credits or dissatisfaction with the AI's analysis opinion.
  • If a technical error prevents analysis, please contact support for a credit restoration.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

8. TERMINATION

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
